Types of TABC/Comptroller Bonds

Performance Bond (TABC) - Applies to Bexar, Dallas, Harris and Tarrant Counties only. Required by holders of a Beer Retailer’s On Premise License or a Wine and Beer Retailer’s Permit who does not hold a Food and Beverage Certificate. Initial amount is $2,000 and will increase due to a violation of the TABC Code.

Conduct Surety Bond (TABC)- Required by all retailers who do not hold a Food and Beverage Certificate. The amount of the bond is determined by the distance to a public school. If the location is over 1,000 feet from a public school, the bond amount will be $5,000. If the location is less than 1,000 feet from a public school, the bond amount will be $10,000.

Mixed Beverage Gross Receipts and Sales Tax Bonds (Comptroller) - In addition to conduct surety bonds that the Texas Alcoholic Beverage Commission requires, mixed beverage and private club permittees must post two separate bonds as security for the payment of taxes:

  • one bond for the 6.7 percent mixed beverage gross receipts tax; and

  • one bond for the 8.25 percent mixed beverage sales tax.

Continuous Bond Of Seller (Sales Tax) - The Comptroller may from time to time require a seller to obtain a sales tax bond to ensure the business pays its sales taxes and other statutory requirements the State has set forth.  These bonds are not always needed but are required only when the Comptroller requests it.
